General Terms and Conditions of Business

1. scope of application

For all orders via our online shop by consumers and entrepreneurs the following terms and conditions apply.

Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity can be attributed. Entrepreneur is a natural or legal person or a partnership with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.

In relation to entrepreneurs, these General Terms and Conditions shall also apply to future business relations without us having to refer to them again. If the entrepreneur uses conflicting or supplementary General Terms and Conditions of Business, their validity is hereby objected to; they shall only become part of the contract if we have expressly agreed to them.

2. contracting party, conclusion of contract

The contract of sale is concluded with Mach Dich Wach! GmbH.

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalogue. You can put our products into your shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. By clicking on the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order is sent by e-mail immediately after sending the order.

When the contract with us is concluded depends on the payment method you have chosen:

Klarna financing

We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within two days.

Invoice

We accept your order by sending a declaration of acceptance in a separate e-mail within two days, in which we provide you with our bank details. You will receive an invoice with a 14-day payment term, which is included in the delivery.

Credit card

When you place your order, you simultaneously send us your credit card details. After your legitimation as a legitimate cardholder, we will ask your credit card company to initiate the payment transaction and thereby accept your offer.

PayPal, PayPal Express

During the order process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment order to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

Sofort by Klarna

After placing the order you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment order. Thereby the contract with us is concluded.

Apple Pay

During the order process you will be redirected to the website of the online provider Apple. There you can enter your payment details and confirm the payment order to Apple. After placing the order in the shop, we ask Apple to initiate the payment transaction and thereby accept your offer.

3rd contract language, contract text storage
The language available for the conclusion of the contract is German.

We save the contract text and send you the order data and our terms and conditions by e-mail. For security reasons the contract text is no longer accessible via the Internet.

4. terms of delivery

In addition to the indicated product prices there may be shipping costs. You will find more detailed information about possible shipping costs in the offers.

We only deliver by mail. Unfortunately, it is not possible to pick up the goods yourself.

5. payment

In our shop, the following payment methods are available to you:

Invoice

In order to pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Sofort by klarna

After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that is activated for online banking, prove your identity accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Apple Pay

In order to pay the invoice amount via Apple Pay, you must use the "Safari" browser with which service provider Apple is registered, have activated the Apple Pay function, identify yourself with your access data and confirm the payment order to us. The payment transaction will be carried out immediately after placing the order. You will receive further instructions during the ordering process.

Financing via Klarna
In cooperation with Klarna AB(www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you the instalment purchase as a payment option. Please note that Klarna hire purchase is only available for consumers and that payment must be made to Klarna.
Klarna's financing service allows you to pay for your purchase flexibly in monthly instalments of at least 1/24 of the total amount (but at least €6.95).

6. retention of title

The goods remain our property until full payment has been received.
For entrepreneurs the following applies additionally: We reserve the right of ownership of the goods until all claims from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale - irrespective of any combination or mixing of the goods subject to retention of title with a new item - in the amount of the invoice amount, and we accept this assignment. You remain authorised to collect the claims, however, we may also collect claims ourselves if you do not meet your payment obligations.

7. warranty and guarantees

The statutory liability for defects shall apply. Information on any additional warranties that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

The Mach Dich Wach! GmbH grants consumers a six-month money-back guarantee. If you are not satisfied with a product or do not tolerate it, you can contact us within six months of purchase and receive a refund. This manufacturer's guarantee is voluntary and does not affect your statutory rights of revocation and defects. The money-back guarantee is valid within the EU and Switzerland. We reserve the right to revoke this voluntary guarantee in the event of excessive use or misuse.

9. dispute resolution
The European Commission provides an Online Dispute Resolution (OS) platform, which you can find here https://ec.europa.eu/consumers/odr/. Consumers have the possibility to use this platform to settle their disputes.
For the settlement of disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute settlement proceedings before a consumer arbitration board. The competent authority is the Universalschlichtungsstelle des Bundes am Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.universalschlichtungsstelle.de. We will participate in dispute resolution proceedings before this body.
